1. Agreement to These Terms

These Terms & Conditions apply to every rental booked with Party Kids America (“Party Kids America,” “we,” “us”). By placing a reservation, paying a deposit, or using our equipment, you (“Customer”) agree to these terms. If you book on behalf of someone else, you agree to them on that person’s behalf.

2. Reservations and Deposits

A 50% deposit is required to reserve your rental date. Your reservation is not confirmed until the deposit is received. The remaining balance is due 48 hours before your event. Rentals are subject to availability, and prices may change until a reservation is confirmed.

3. Cancellations and Rain Checks

We offer a rain check policy instead of refunds. If you need to cancel, or your event is affected by weather, you may reschedule your rental for any available date free of charge. Your deposit and any payments made will be applied to the rescheduled date.

4. Weather and Safety Decisions

Inflatables must not be used during high winds, rain, lightning, or other unsafe weather. Our crew may delay or decline setup, or ask that equipment be taken out of use, if conditions are unsafe. If weather prevents your rental, you may reschedule under our rain check policy. If unsafe weather begins during your event, you agree to stop all use of the inflatable immediately and keep everyone off it until conditions are safe.

5. Delivery, Setup, and Takedown

All rentals include delivery, setup, and takedown by our crew. We are delivery-only and do not offer customer pickup.

• Delivery is free within a 10-mile radius.
• Delivery beyond 10 miles is calculated automatically at checkout when you enter your event address.
• Delivery and pickup times are estimates. We will make every effort to arrive within the scheduled window, but delays from traffic, weather, or other events may occur.
• Please do not move, relocate, or reposition any equipment after our crew sets it up.

  6. Setup Area Requirements

  You are responsible for providing a suitable setup area. Please make sure that:

• The setup area is within 100 feet of a working standard electrical outlet.

• The area is flat, clear, and large enough for the rental. Exact length, width, and height for each item are listed on its product page.
• The area is free of rocks, sticks, pet waste, sprinkler heads, and other debris or sharp objects.
• Our crew has a clear path to the setup area, including through gates.
• You have notified us in advance of any underground utilities, sprinkler lines, or HOA rules that could affect setup.
• Our crew may decline to set up in any location they consider unsafe.

  7. Supervision and Customer Responsibilities

  A responsible adult (18 or older) must supervise all users at all times while equipment is in use. You agree to:

• Follow all safety rules provided with the rental and posted on the equipment.
• Keep the number and size of users within the limits for that unit, and group users of similar size and age together.
• Keep the blower running and unobstructed at all times while the unit is in use.
• Stop all use and contact us right away if the unit loses air, is damaged, or appears unsafe.
• Keep everyone off the equipment during setup and takedown.
  

  8. Prohibited on Inflatables

  The following are not allowed on or in any inflatable:

• Shoes
• Sharp objects, including jewelry, keys, and items in pockets
• Markers, pens, or anything that can write on or stain the unit
• Food, drinks, and gum
• Confetti and silly string
• Flips, wrestling, rough play, or climbing on walls or netting
  

  9. Damage, Loss, and Cleaning

  You are responsible for the equipment from the time it is delivered until it is picked up. You are responsible for loss of, or damage to, equipment caused by misuse, negligence, prohibited items, or failure to follow these terms, beyond normal wear and tear. This includes repair or replacement costs and any extra cleaning needed because of prohibited items, such as marker, silly string, food, or excessive mud. Normal wear and tear and ordinary use are not charged.

  10. Assumption of Risk and Release

  Use of inflatables, water slides, and other recreational equipment involves inherent risks, including falls, collisions, and physical injury. By renting from us, you acknowledge these risks and accept responsibility for the safe use of the equipment by you and your guests. To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless Party Kids America, its owners, and its employees from any claims, injuries, losses, or damages arising from the use or misuse of rented equipment, except where caused by our gross negligence or willful misconduct.

11. Payments

Payments are processed securely through our online booking system. By completing a booking, you authorize us to charge the payment method provided for the deposit, the remaining balance, and any applicable fees described in these terms.

12. SMS Terms

SMS Messaging Program. Party Kids America offers a text messaging program to customers who opt in. By providing your mobile number and checking the SMS consent box, you agree to receive text messages from Party Kids America.

Types of Messages. Messages may include booking confirmations, delivery and setup updates, event reminders, customer service replies, and occasional promotional offers.

Message Frequency. Message frequency varies based on your bookings and interactions with us. Cost. Message and data rates may apply. Check with your mobile carrier for details on your plan.

Opting Out. You can cancel at any time by replying STOP to any message. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent unless you opt in again.

Consent Not Required. Consent to receive text messages is not a condition of renting from or purchasing anything from Party Kids America.

Carrier Liability. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. Your mobile information is handled according to our Privacy Policy. We do not sell or share your mobile number or SMS opt-in data with third parties for marketing purposes.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. The version posted on our website at the time of your booking applies to your rental.

14. Governing Law

These terms are governed by the laws of the State of Texas.
